Article 1 - Definitions
The terms used in these terms and conditions shall have the following meanings assigned to them:
Remembr./we/us: the functionality and services we provide, of which our website www.remembr.com, related domain extensions and sub domains and all our other media and software that will be developed in the future.
Remembr BV/we/us: the owner and any (legal) persons that have been appointed by the owner to manage the website and apply these terms and conditions.
Visitor/user/you: the (legal) person who uses the facilities of the website in any way
Website: www.remembr.com and related domain extensions and sub domains that are operated by Remembr BV.
Agreement: the agreement to accommodate and use of the website.
Information: facts and other information about you, including actions taken by users and non-users who interact with Remembr.
Content: anything you or other users post on Remembr. that would not be included in the definition of information.
Data/user data/user’s data: any data including a user’s content or information that you or third parties can retrieve from Remembr.
Terms and conditions: these terms and conditions of use, including the privacy and cookie policy that is published in a separate document.
Article 2 - Applicability

Article 3 – Duration of the agreement
3.1

The agreement between you and Remembr. is concluded for an indefinite period. It continues as long as the services are provided or when the agreement is terminated by Remembr. The agreement may at any time and immediately be terminated.

You are no longer entitled to have any acces to content that is placed by you for a definite or indefinite period after the agreement is terminated.

Using the website
Article 4 - Privacy 
and processing your personal data
4.1

By using or accessing Remembr. you allow us to used all the data and information we collect about you.
|
4.2
|
Your data, content en information is stored by Remembr BV. They are treated with the utmost care and security. In accordance to the Dutch law for personal data protection we have registered this data processing at the “College Bescherming Persoonsgegevens”, registration number xxxx.

4.3
|
Remembr BV can use your data, content and information for analysis and direct marketing purposes. Remembr BV can combine your data with data of other databases that (partly) belong to Remembr BV. We do not share information we receive about you, unless we:

- have received your permission;
- have given you notice, such as by telling you about it in these terms and conditions or privacy and cookie policy;
- have removed your name and any other personally identifying information from it;
- have a legal obligation to hand over the information we have about you; or
- are involved in a merger, acquisition, bankruptcy, dissolution or similar situation where user information, including personal data are transferred.

If you want to delete your information from the database of Remembr BV you can delete your memories, memorial pages or your account. You can also request a viewing, correction, deletion, data transfer of your personal data or request for withdrawal of your consent or object to the processing of your personal data to info@remembr.com. To ensure that the request for access has been made by you, we ask you to send a copy of your ID with the request.

Other terms are in the privacy and cookie policy that is separately published on this website. By using Remembr you not only accept the terms and conditions for users but also the relating privacy and cookie policy.

Article 5 – Sharing content and information
5.1

You own all of the content and information you post on Remembr. For content that is covered by intellectual property rights, like photos and videos (IP content), you specifically give us the following permission: you grant us a non-exclusive, transferable, sub-licensable, royalty-free worldwide license to use any IP content that you post on or in connection with Remembr. (IP license). This IP license ends when you delete your IP content or your account unless your contribution has been shared with others, and they have not deleted it.

When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content has been shared may persist in backup copies for a reasonable period of time (but will not be available to others).

When you publish content or information on a memorial page with the Public setting, it means that you are allowing everyone, including people off of Remembr., to access and use that information, and to associate it with you (i.e. your name and profile picture).

5.4
|
We always appreciate your feedback or other suggestions about Remembr., but you understand that we may use them without any obligation to compensate you for them (just as you have no obligation to offer them).

Article 6 - Safety
We do our best to keep Remembr. safe, but we cannot guarantee it. We need your help to keep Remembr. safe, which includes the following commitments by you:

You will not post unauthorised commercial communications (such as spam) on Remembr.
|
6.2
|
You will not collect users’ content or information, or otherwise access Remembr., using automated means (such as harvesting bots, robots, spiders or scrapers) without our prior permission.
|
6.3
|
You will not upload viruses or other malicious code.
|
6.4
|
You will not solicit login information or access an account belonging to someone else.
|
6.5
|
You will not bully, intimidate, or harass any user.
|
6.6
|
You will not post content that: is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.

You will not use Remembr. to do anything unlawful, misleading, malicious, or discriminatory.

6.8
|
You will not do anything that could disable, overburden, or impair the proper working or appearance of Remembr. such as a denial of service attack or interference with page rendering or other Remembr. functionality.

You will not facilitate or encourage any violations of these terms and conditions.

Article 7 – Registration and account security
Remembr. users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating registering and maintaining the security of your account:

You will not provide any false personal information on Remembr., or create an account for anyone other than yourself without permission.
|
7.2
|
You will not create more than one personal account.
|
7.3
|
If we disable your account, you will not create another one without our permission.
|
7.4
|
You will not use Remembr. for your own commercial gain.
|
7.5
|
You will keep your contact information accurate and up-to-date.
|
7.6
|
You will not share your password, let anyone else access your account, or do anything else that might jeopardise the security of your account.

|
You will not transfer your account (including any memorial page you administer) to anyone without first getting our written permission.

7.8
|
If you select a username or similar identifier for your account or memorial page, we reserve the right to remove or reclaim it if we believe it is appropriate (such as when a trademark owner complains about a username that does not closely relate to a user’s actual name).

Article 8 – Protecting other people’s rights
We respect other people’s rights, and expect you to do the same.
8.1

You will not post content or take any action on Remembr. that infringes or violates someone else’s rights or otherwise violates the law.
|
8.2
|
We can remove any content of information you post on Remembr. if we believe that it violates these terms and conditions or our policies.
|
8.3
|
Notify us if your intellectual property rights are violated. When we receive a valid notice of intellectual property infringement, we promptly remove or disable access to the allegedly infringing content. We also terminate the accounts of repeat infringers in appropriate circumstances.

8.4

If we remove your content for infringing someone else's copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.

If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate.

You will not use our copyrights or trademarks (including Remembr. the Remembr.-logo and the R-logo), or any confusingly similar marks, except with our prior written permission.

If you collect information from users, you will: obtain their consent, make it clear you (and not Remembr.) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.

Article 9 - Advertisements and other commercial content served or enhanced by Remembr.

Final provisions
